Service-Specific Guidelines

Chapter 1. Generals

Article 1 (Purpose)

The purpose of these Terms and Conditions is to stipulate the rights, obligations, and responsibilities of the site and users regarding use of services (hereinafter, “Services”) provided by the Mathematical Attitude and Practices Test Website (hereinafter, “Site”) provided by the Kangwon University-Industry Cooperation Foundation.

Article 2 (Definitions)

  • “User” means a member or non-member who accesses the Site and receives Services provided by the Site in accordance with these Terms and Conditions.
  • “Member” means a person who has signed up for membership by providing personal information to the Site, and can continue to receive information from the Site and use Services provided by the Site.
  • “Non-member” means a person who uses Services provided by the Site without signing up as a Member.
  • “Withdrawal” means the termination of the User Agreement by the Site or the Member.

Terms used in these Terms and Conditions, which are not defined herein, follow those specified in applicable laws and regulations and Service-Specific Guidelines, and otherwise general practices.

Article 3 (Rules Other than Terms and Conditions)

The Site may set individual terms and conditions or operating principles (hereinafter, “Service-Specific Guidelines”) for individual items within Services if deemed necessary. In the event of any conflict between these Terms and Conditions and Service-Specific Guidelines, Service-Specific Guidelines shall prevail.

Article 4 (Provision and Change of Services)

  • The following Services shall be provided by the Site:
    • Mathematical attitude and practices test (e.g., test administration, result management); and
    • Any other service(s) that the Site additionally develops or provides to Members through partnership agreements with a third party.
  • The Site may change the contents of the Services to be provided under an agreement to be entered into if technical specifications are changed. In such cases, the contents and date of provision of the changed Services shall be specified and notified where the contents of the current Services are posted prior to the date of the provision. In the event that there are unavoidable conditions or circumstances that the Site cannot reasonably predict, however, the above notification may not be made.
  • The Site may modify, suspend, or change some or all of the Services provided according to the Site’s policies and operations, and no separate compensation shall be provided to Members for such modification, suspension, or change unless otherwise specified under applicable laws.

Article 5 (Suspension of Services)

  • The Site may temporarily suspend the provision of Services in the event of reasons, such as the maintenance, replacement, or failure of information and communications facilities, including computers, or the interruption of communications.
  • In the event of the suspension of Services under (1), the Site shall notify the suspension to Members on its Website. In the event that Services are suspended because of reasons that cannot be reasonably predicted by the Site, the Site shall notify the suspension after the event.

Chapter 2. Entering into the User Agreement

Article 6 (Membership)

  • The User shall apply for membership by entering the membership information in the sign-up form determined by the Site and indicating his or her consent to these Terms and Conditions.
  • Consent to the User Agreement shall be provided by clicking the Agree button on the application form at the time of application.
  • The Membership Agreement shall be established when the approval of the Site is received by the Member.
  • The Member shall provide all other information (nationality, gender, age, nickname, etc.) requested by the Site if the Member wants to use the Services provided by the Site.
  • All Members must provide their own information to use the Services, and Members who do not register their actual information by stealing other people's information or registering false information, cannot claim any rights in relation to the use of the Services, and may be subject to punishment under applicable laws and regulations.

Article 7 (Membership Withdrawal and Disqualification, etc.)

  • Members may request withdrawal from the Site at any time, and the Site shall immediately process the request for withdrawal.
  • Members may request withdrawal at any time if they do not want the Site to provide membership information to any other potential partner site in the future.
  • The Site may restrict or suspend membership for the Members who:
    • Register false information when applying for membership;
    • Threaten the order of electronic transactions by interfering with the use of the Site by others or stealing their information;
    • Use the Site to engage in any act prohibited by applicable laws and regulations and these Terms and Conditions or contrary to public order or good customs;
    • Transmit, post, e-mail, or otherwise disseminate to others the information, statements, shapes, sounds, or videos containing vulgar or obscene content that violates public order and good customs, or content that may infringe on the name or privacy of others;
    • Change the client program of the Site without being authorized by the Site, hack the server of the Site, or arbitrarily change the Site or posted information in part or in whole;
    • Reproduce the information obtained from Services for purposes other than using the Services, use it for publication and broadcasting, or provide it to a third party without prior consent from the Site;
    • Receive any request for correction from public institutions, such as the Korea Communications Standards Commission;
    • Violate any regulations set by the Site, including the Terms and Conditions, or applicable laws and regulations, such as being objectively determined to be involved in a crime.
  • If the Site disqualifies a Member, the Member's registration shall be revoked.

Article 8 (Protection and Use of Personal Information)

  • The Site shall make its best effort to protect the personal information of Members in accordance with applicable laws and regulations. Applicable laws and regulations and the privacy policy of the Site shall apply to the protection and use of personal information. The privacy policy of the Site, however, shall not apply to linked sites other than the official site of the Site. Furthermore, Members must thoroughly safeguard their password and other information to prevent potential disclosure to others, and the Site shall not be held liable for the information disclosed because of reasons attributable to Members.
  • The Site may provide the personal information of Members to a third party to the extent permitted by applicable laws in the following cases in which:
  • It is requested to provide information by an investigative agency or other government agency;
  • It is necessary for information protection tasks, such as checking for misconduct, including violations of applicable laws or the Terms and Conditions by Members; and
  • It is otherwise required by applicable laws.

Chapter 3. Obligations of the Parties

Article 9 (Obligations of the Site)

  • The Site shall make Services available to Members from the date of commencement of the provision of Services that Members want, unless there is any special circumstance.
  • To provide continuous and stable Services, the Site shall immediately repair or restore the facilities disrupted or destroyed unless there is any special circumstance.
  • The Site shall establish a security system to protect personal information and make public and comply with the privacy policy.
  • The Site shall not disclose or distribute Members’ personally identifiable information to others without obtaining consent from Members. The above, however, shall not apply if requested by competent national authorities under applicable laws, including telecommunications-related laws and regulations.
  • The Site shall immediately address opinions or complaints raised by Members through the due process if they are deemed objectively justified. In the event that it is difficult to address them immediately, the reason and processing schedule shall be notified to the Members.

Article 10 (Obligations of Members)

  • Members shall enter their actual information based on facts when applying for membership or changing membership information, and shall not claim any rights related thereto if they register false or other people's information.
  • Members shall comply with what is stipulated in the Terms and Conditions and other regulations and notices made public by the Site as well as applicable laws and regulations, and shall not engage in any act that potentially interferes with the business of the Site, tarnishes its reputation, or causes harm to others.
  • Members shall not engage in any act that potentially infringes on any rights of the Site, including intellectual property rights.

Chapter 4 Miscellaneous

Article 11 (Service Hours)

  • In principle, the use of Services shall be available 24 hours a day, seven days a week, 365 days a year, unless there is any special disruption in the business or technology of the Site. Services, however, may be suspended on a number of days or hours determined by the Site for the regular maintenance, expansion, and replacement of the system, and the suspension of the Services due to scheduled work shall be notified by the Site in advance.
  • The Site may suspend the provision of Services in whole or in part after notifying Members in advance if necessary for operating the Services, including updating the Services.

Article 12 (Copyright and Restriction of Use)

  • Copyright and other intellectual property rights for any posts or works created by the Site shall belong to the Site.
  • The User shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use, or allow a third party to use the information obtained by using the Site and works on the Site for commercial purposes without obtaining prior consent from the Site.
  • The copyright of any post uploaded by any Member within Services shall belong to the Member who uploaded the post. However, the Site may use the posts uploaded by Members without separate permission from the Members without paying the price within a reasonable extent consistent with fair practices stipulated under applicable copyright laws for the purposes of operating, displaying, transmitting, distributing, and promoting Services to:
  • Reproduce, revise, modify, display, transmit, distribute, and create edited works from Members’ posts within Services to the extent that the works do not harm copyright ability; and
  • Provide, display, or promote the contents of Members’ posts to service partners, such as media and telecommunications companies. In such a case, however, the Site will not provide Members’ personal information other than their User ID without separate consent. To use Members’ posts, prior consent must be obtained from the Members by means of e-mail.

Article 13 (Members’ Posts, etc.)

  • Members’ posts mean articles, photos, files, links, etc. posted by Members during the use of Services.
  • In the event that Members causes damages or other problems to themselves or others because of the posts uploaded by the Members on Services, the Members shall be held responsible, and the Site shall not be held liable unless there is any special circumstance.
  • The Site may take applicable measures, such as temporary posting, suspending, modifying, deleting, relocating, or refusing to upload any of the following posts, without prior consent from Members, which:
    • Disseminate or link to the content that violates public order and good customs;
    • Promote piracy or hacking;
    • Include any advertisement for profit;
    • Include any content objectively deemed connected to a crime;
    • Infringe on the copyright or other rights of other Users or a third party;
    • Include any content about personal political judgment or religious views, which are deemed inconsistent with the nature of the Services of the Site;
    • Violate the post principles stipulated by the Site or are inconsistent with the nature of the bulletin board; and
    • Are deemed to be in violation of other applicable laws and regulations.
  • The Site may temporarily suspend any post if it receives a request from a third party to suspend the post because of the infringement of rights, including defamation or intellectual property rights, and any lawsuit, settlement, or any other equivalent decision by a competent organization made between the party who made a request and the party who uploaded the post shall be followed if it is received by the Site.
  • In the event that any post is temporarily suspended, the Member who uploaded the post may request the Site to repost (resume transmission), and if the repost is not requested within three months from the date of suspension, the Site may delete the post.

Article 14 (Provision of Information)

  • The Site may collect additional personal information in accordance with applicable laws and regulations with consent from Members for the purpose of improving Services and introducing Services to Members.

Article 15 (Compensation for Damages)

  • The Site and the User shall compensate the other party for damages caused by intentional or negligent acts in relation to the use of Services.
  • The Site shall not be held liable for any damages in relation to the use of Services provided for free unless it violates what is specified in the privacy policy.

Article 16 (Indemnification)

  • The Site shall be indemnified and held harmless from any liability for the provision of Services if it is unable to provide the Services because of natural disasters, war, suspension of services by an infrastructure telecommunications provider, or other equivalent force majeure events.
  • The Site shall be indemnified and held harmless from any liability for damages caused by inevitable reasons, including the repair, replacement, regular inspection, and construction of facilities for Services.
  • The Site shall be indemnified and held harmless from any liability for damages caused by the Member's computer error, or incorrectly entered personal information.
  • The Site shall be indemnified and held harmless if Members fail to achieve or lose expected benefits from the use of Services, and shall not be liable for damages caused by data obtained during the use of the Services.
  • The Site shall be indemnified and held harmless from any liability for content, including the reliability and accuracy of information, materials, and facts posted by Members on Services, have no obligation to intervene in disputes between Members and between Members and a third party on Services, and not be held liable for compensating for any damages arising therefrom.
  • The Site shall have no obligation to pre-screen Members' posts before registration or to check or review the contents of the posts at all times, and shall not be held liable for the results.

Addendum
These Terms and Conditions shall take effect on March 1, 2024.
